ZUSIA® PRIVACY NOTICE

This Privacy Notice (“Notice”) sets out the privacy practices for the website located at http://www.zusia.com and mobile application (the “Site”).

The Site is operated by Disability Know-It-All LLC, d/b/a Zusia® (the “Company”). As used herein, the words “User,” “You” and “Your” refer to users of the Site and the words “We,” “Our” and “Us” refer to the Company.

This Notice applies to the information We gather about You while You use the Site, and the ways in which We use and share that information. This Notice does not apply to information You may provide to Us, or that We may collect, offline and/or through other means (for example, by telephone or in the mail).

The Site may have links to third party websites, such as websites hosted by third party providers of services that may interest You (“Linked Sites”). When You click on such a link, You will leave the Site and be directed to the Linked Site. This Notice does not apply to Linked Sites. We have no control over, do not review or endorse, and are not responsible for any Linked Sites or their privacy practices. We encourage You to review the privacy notices of any Linked Sites You access.

Please read this policy carefully to understand our policies and practices regarding Your information and how We will treat it. If You do not agree with our policies and practices, then You should not continue to use our Site.

  1. Information We Collect

We collect and retain information through the Site, including personally identifiable information about You. Some information You may provide to Us voluntarily, while other information We gather through various means. The following explains what We collect and how We collect it.

You will need to provide certain information if You would like to use, or participate in, optional features of the Site, such as registering an Account for membership (“Account”). We collect the information You provide, and will use and disclose that information as explained in this Notice. How We use and disclose that information may be supplemented by terms set out in the area where You provide the information.

  1. Your Account

If You register for an Account, You will need to provide certain information, such as Your first and last name, password and e-mail address. You may also have the option to provide additional information about Yourself for a user profile, such as Your photo and birthdate.

If You purchase an upgraded membership, to pay for Your purchase You will provide Our third party payment processing company certain financial information, such as Your credit card number, type and expiration date, along with Your name and address. The payment processor is permitted to use that information to process payment for Your membership. We do not collect any of Your financial information, and are not responsible for how it is handled.

  1. Service Providers

If You would like to be considered for our service referrals, You may complete a Service Provider application online, or by hand. We will collect the information You provide in connection with our service referral program. If You wish to complete the Service Provider Application by hand, please print out the relevant document, and mail it to:

You may have the opportunity to provide information at other areas of the Site. You will be informed if the information collected is used or disclosed in a manner that differs from that stated in this Notice. These include, for example:

If You provide us feedback through a form or contact us via e-mail, We will collect Your name and e-mail address, as well as any other content or information You provide.

You may provide information to us by participating in surveys, promotions or other solicitations.

  1. Device and Communications Information

When You access the Site through a web browser, We collect certain technical information that identifies Your computer, software and Internet Service Provider (ISP), such as Your Internet Protocol (IP) address (a unique number that is automatically assigned to Your computer whenever You are surfing the web); Your MAC address (a unique number that is assigned to Your network card by the manufacturer); date/time stamps for Your visit; Your domain name; Your browser type and version; and/or Your operating system.

When You access Our mobile application, We collect Your mobile phone number and the unique device ID number of the mobile device, the unique identifier assigned to Your mobile device for advertising purposes, such as Your Identified for Advertising (IDFA) or Google Advertising ID (AAID), as well as information about Your mobile device model, software version and/or mobile communications carrier.

In some cases, We have arrangements with third parties to collect and store the foregoing information for Us, e.g., to provide services in connection with hosting or the operation of the Site, or to facilitate reporting of analytics regarding the Site (such as with Google Analytics).

  1. Cookies and Web Beacons

The Site employs browser-based, HTTP cookies, which are small text files placed on Your computer's hard drive or mobile device’s broad storage and subsequently read by the domain owner of the website that placed them as You visit that website, as well as web beacons (also known as pixel tags), which are electronic images embedded into a web page, and HTML5 storage which allows data to be stored locally within the browser, in lieu of cookies.

We and/or Our third party vendors utilize persistent cookies in connection with the Site, which are cookies that remain within Your computer or mobile device over a period of time. In addition to our creating and placing a HTTP cookie on Your computer or mobile device, We have arrangements with third party vendors which may also create and place HTTP cookies on Your computer or mobile device as You visit the Site. These third parties collect and store information to provide services to Us.

The first time You visit the Site, We assign You a unique, anonymous ID, which is stored in the cookie file on Your computer or mobile device. This ID is used to identify You as You navigate the Site, and when You return to the Site after having visited elsewhere through the Internet. Among other things, this allows Us to recognize Your return, and to facilitate Your access to Your Account. We collect and retain information regarding Your visits to and navigation through the Site.

If You access our website through a browser, We collect location information provided by Your internet service provider (ISP), such as Your general geographic location. If You access our mobile application, We collect location information provided by the location services features of Your mobile device, such as more specific location positioning.

If You are a registered user, You can log into Your Account to access and edit certain information associated with Your Account, such as Your contact information.

    1. Cookies

You may choose not to accept cookies through a setting on most browsers (which can also be set to notify You each time a cookie is set). If You choose to refuse cookies, or if You delete cookies, You may not be able to use all of the features of the Site.

  1. Do Not Track

Do not track is a voluntary program among Internet advertisers that is intended to give users the ability to opt-out of behavioral advertising. There are a few ways in which Your computer may transmit a do not track signal to certain websites and online Site You visit, and currently no standard has been established. We do not respond to do not track signals, and the settings in Your browser will have no effect on the Site.

  • Mobile Application Location Controls

You may adjust the settings on most mobile devices to allow Our mobile application to gather, or to disable it from gathering, location positioning data. Certain features may not work as effectively if You disable location positioning data.

  1. Your Personal Choices
  • You may forego registering an Account, thereby limiting the information We collect, and still use some of the features of the Site.
  • You may choose not to provide information to Us, even though it may be needed to take advantage of some of the features of the Site.
  • You may choose not to use the Site.
  • You may terminate Your Account.
  1. Terminating Your Account

You may terminate Your Account by e-mailing support@zusia.com. If You terminate Your Account, any association between Your Account and information We store will no longer be accessible through Your Account. We may retain the information collected prior to termination for archival and/or legal purposes. Any information You shared in community areas of the Site will remain in those areas until it is deleted in accordance with Our retention policy.

  1. Children

The Site is not directed anybody under the age of 18. We do not knowingly collect personal information from anybody under the age of 18, nor do We knowingly distribute such information to third parties. If We become aware that We received personal information from someone under the age of 18, We will take steps to delete such information from Our records.   1. Outside the United States

The Site is intended for U.S. users within the U.S. The Site is not intended for use outside the U.S. If You are a non-U.S. user of the Site, Your information may be collected and processed in the country in which You reside and/or in other countries, including the U.S., where laws regarding the collection and processing of personal information may differ from the laws in Your country.

  1. How We Use Information

We use the information We collect to:

  • Operate, maintain and improve the Site;
  • Respond to comments and questions and provide customer service;
  • Send information including confirmations, invoices, technical notices, updates, security alerts and support and administrative messages;
  • Communicate about promotions, events and other products and services offered by Us and/or by third parties;
  • Protect, investigate and deter against fraudulent, unauthorized or illegal activity;
  • Provide and deliver the information, products and services You request;
  • Identify You as a user in Our system;
  • Facilitate the creation of and secure Your Account on Our network; and
  • Develop and improve marketing and advertising for the Site.
  1. Improvement of the Site

To help Us improve and enhance the Site, We use cookies and web beacons for record keeping, to track Your movements when You visit the Site and to help us and our authorized third party analytics vendors to understand how the Site is utilized. We may use this information in aggregate form or, alternatively, We may keep the information in an individual profile. We may also use the information You provide to Us, such as feedback, to help Us improve and enhance the Site.

  1. Service Providers

The information provided by Service Providers who submit an application online will be used in connection with our service referral program, which includes such things as checking references, background investigations and confirming legal eligibility, and assisting members in selecting suitable providers.

  1. Fraud Detection and Security

We and/or the third party vendors We engage may use the information generated from cookies in a way for that information to be linked with information that identifies You as an individual for fraud detection purposes. We will use the information in Your Account in an effort to ensure that Your Account is not misused.

We use IP addresses, MAC addresses and other computer or device identifying technologies to identify a user when We feel it is necessary to enforce compliance with our Terms of Use or to protect the Site, our customers or other individuals.

  1. Marketing and Advertising

We use cookies and other technologies to identify that Your web browser or mobile device has accessed aspects of the Site and may associate that information with Your Account if You have one. We and/or the third party vendors We engage may use the information You provide and that is generated from cookies and other technologies to identify You as an individual in order to serve communications, marketing and advertisements to You on Our behalf.

We may also use third party analytics services, advertising companies and advertising networks to help analyze how users use and navigate the Site so that We may tailor the Site for You and customize the advertisements that are displayed to You, both through the Site and through other channels such as on other websites. These companies may use information about Your visits to the Site and other websites on our behalf, in order to provide advertisements about goods and services that may be of interest to You. This information is only used for advertisements from us and from those third parties with which We have an arrangement for us to provide their advertisements to You; We do not disclose Your personal information to third parties for them to advertise to You directly.

California Civil Code Section § 1798.83 permits users of our Website who are California residents to request certain information regarding Our disclosure of personal information to third parties for their direct marketing purposes in the preceding calendar year.   1. De-Identified Data

We may create de-identified data records and “aggregate data” reports about how users use the Site, such as the number and frequency of visitors to the Site, which may be derived from personal information. This information cannot be readily tied back to You, Your Account, Your web browser or Your mobile device. We may use this de-identified information for any other purpose, such as to enhance the content of and improve the Site, for example by allowing us and third parties authorized by us to ascertain how often individuals use areas of the Site so that We may focus on and improve those areas.

Information in Your user profile such as Your username, photo, birthday and other information You enter may be displayed to other users of the Site to facilitate user interaction within the Site. We will not reveal Your e-mail address, telephone number or physical address to other users.

We do not collect, and therefore do not share, Your financial information. The information collected by Our payment processor is governed by their privacy notice. The payment processor (currently, PayPal) is identified when You pay for an upgraded membership.

We may share with third parties Your communications with Us, such as sharing Your feedback with Our vendors to improve the Site. We may also share Your communications with third parties that provide marketing and advertising on Our behalf. We do not share Your personal information with third parties where not necessary for them to provide services for Us.

  1. Surveys, Promotions, etc.

If We sponsor surveys, promotions or other solicitations for third parties, We may share the information You provide with those third parties. We may also share such information with third parties that provide marketing and advertising on Our behalf.

  1. Public Postings

Some of Your activity on and through the Site is public by default. This may include, but is not limited to, content You post in community areas through message boards, blogs or reviews on the Site. If You choose to provide information using public features of the Site, that information may be governed by the privacy settings of those particular features and may be publicly available. Individuals reading such information may use or disclose it to other individuals or entities without our control and without Your knowledge, and search engines may index that information.

If You mistakenly post personal information in Our message board areas and would like it removed, You can send us an email to request that We remove it by using the Contact link on every page of the Site. In some cases, We may not be able to remove Your personal information.

Information submitted by service providers may be disclosed to third parties to assist in our service referral program, such as for purposes of checking references, background investigations and confirming legal eligibility.

We share IP address and other computer identifying information with third party vendors that assist in our provision of the Site and with other persons with whom We conduct business as specified in this Notice. This includes third parties that provide marketing and advertising on our behalf.

If We undergo a corporate transaction, such as selling assets to another entity, or if We are acquired by or merged with another entity, whether by merger, consolidation, reorganization or otherwise, We may disclose and transfer to such entity the information We have collected, including Your personal information, that is related to that part of our business that was sold to or merged with the other entity. We will take steps to assure that any personal information is used in a manner consistent with this Notice.

  1. Our Protection and the Protection of Others

We may access, read, preserve and disclose all information, including personal information, to (i) satisfy applicable laws, rules regulations, legal processes and governmental requests, and to comply with judicial proceedings or court orders, (ii) enforce this Notice and our Terms of Use, including investigation of potential violations hereof and thereof, (iii) detect, prevent or otherwise address fraud, security or technical issues, (iv) respond to user support requests, and/or (v) protect the rights, property and safety of our companies, partners, contractors, customers, Site users, and the public. This includes exchanging information with other companies and organizations for fraud protection, credit risk reduction and spam/malware prevention, to report any suspected illegal activity to law enforcement for investigation or prosecution and/or in connection with legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property and/or the rights or property of any third party. We may release information concerning any user when that user is in violation of the Terms of Use or other published guidelines or partakes (or is reasonably suspected of partaking) in any illegal activity.

We may share Your information to fulfill the purpose for which You provide it, or for any other purpose disclosed by us when You provide the information, or with Your consent, or to third parties designated by You.

We share de-identified information with third parties at Our sole discretion.

  1. Information Security

We are committed to protecting the security of the information collected through the Site and implement generally accepted standards of information technology security designed to protect information from loss, misuse and unauthorized access, disclosure, alteration or destruction. It is not possible, however, to guarantee the security or integrity of information online due to, among other things, technological limitations and the fact that no data connectivity via or transmission over the Internet is completely secure.

Your Account information will be protected by a password. It is Your responsibility to prevent unauthorized access to Your Account by selecting Your password and keeping it confidential. If You are sharing a computer with anyone, We suggest You log out of Your Account and decline to have Your Internet browser remember Your password, in order to prevent subsequent users from gaining access to Your Account.

  1. Changes to this Privacy Notice

We may amend this Notice from time to time. Our use of the information We collect will be governed by the most recent Notice in effect. All versions of this Notice are dated with the effective date of that version of the Notice. If We make changes in the way We collect or use information, We will notify You by posting an announcement through the Site or sending You an e-mail and will change the “Last updated” date written at the top of the Notice.
